Terms and Conditions

Welcome to Highland Auctions. By participating in any of our auctions, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Introduction

  • Company Information: Highland Auctions, located in Orem, Utah, specializes in the sale of fine art, rare books, historic documents, collectibles, and memorabilia. We also represent the unique heritage of Utah, including items related to Mormon history, Utah history, the American Western Expansion, and the broader American West.
  • Acceptance of Terms: By registering and placing bids, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions.

2. Registration and Bidding

  • Eligibility: All bidders must be at least 18 years old and legally able to enter into binding contracts.
  • Registration Process: To bid in our auctions, you must register by providing accurate and complete personal information. Highland Auctions reserves the right to verify the information provided and may reject or revoke registration at its discretion.
  • Bidder Responsibility: All bids placed are legally binding. Bidders are responsible for understanding the terms of each auction and are accountable for the accuracy of the bids they place.

3. Auction Process

  • Auction Types: Highland Auctions offers various types of auctions, including live, online, and sealed bid auctions. Each format may have specific rules outlined prior to the auction.
  • Reserve Prices: Some items may have a reserve price, the minimum amount for which an item will be sold. If the reserve is not met, Highland Auctions reserves the right to withdraw the item.
  • Bidding Increments: Bidding increments are as follows:
     
  • Auctioneer’s Discretion: The auctioneer has the final say in resolving disputes, accepting or refusing bids, and, if necessary, re-opening bidding. This discretion ensures the fair operation of the auction.

4. Payment Terms

  • Buyer's Premium: A buyer's premium of 15% will be added to the hammer price for each item purchased on HighlandAuctions.co, and a premium 20% will be added to the hammer price for each item purchased on LiveAuctioneers.com. This premium is subject to applicable taxes.
  • Payment Methods: We accept the following payment methods: Credit Card, Bank Transfer, Check, PayPal, Venmo, Zelle. Highland Auctions reserves the right to charge processing fees on certain payment types, and/or place holds on items until payment has cleared.
  • Payment Deadlines: Full payment is required within 7 days of the auction's conclusion. Failure to complete payment within this timeframe may result in forfeiture of the item and potential legal action.
  • Late Payments: Late payments may incur an additional charge of $5.00/day.

5. Item Descriptions and Condition

  • Catalog Accuracy: While Highland Auctions strives to provide accurate descriptions and images of each item, all items are sold “as is” without warranties. Bidders are responsible for inspecting items prior to bidding.
  • Condition Reports: Condition reports are available upon request as a courtesy to bidders. These reports are not comprehensive and do not guarantee the condition or authenticity of any item.

6. Shipping and Collection

  • Collection Timeframe: Items must be collected within 14 days of the auction’s conclusion unless alternative arrangements are made.
  • Shipping Services: Shipping may be available for certain items. All shipping costs, including insurance and handling fees, are the responsibility of the buyer. Highland Auctions will not be liable for damage or loss once the item has been handed over to the shipping carrier.
  • Storage Fees: Items not collected within the specified timeframe may incur storage fees of $30 per week.

7. Returns and Refunds

  • All Sales Final: All sales are final. Highland Auctions does not accept returns or issue refunds except in cases of gross misrepresentation or authenticity disputes, subject to Highland Auctions’ discretion.
  • Dispute Resolution: In the event of a dispute, we encourage a resolution through mediation or arbitration as outlined in Section 10.

8. Limitation of Liability

  • No Warranty: Highland Auctions provides no warranties, express or implied, regarding the items for sale, including but not limited to their condition, authenticity, or value.
  • Liability Cap: Highland Auctions' liability for any claim related to an item is limited to the purchase price paid for that item.

9. Privacy Policy

  • Data Collection: Highland Auctions collects personal data from users for registration and transaction purposes. This data is protected in accordance with our Privacy Policy.
  • Third-Party Sharing: We may share user data with third-party service providers for the purpose of facilitating auctions and shipping. No personal data is sold to third parties.
  • User Rights: Users have the right to access, modify, or request deletion of their data. For more information, please review our Privacy Policy.

10. Governing Law and Dispute Resolution

  • Jurisdiction: These Terms and Conditions are governed by the laws of the State of Utah. All legal proceedings will be conducted in Utah County, Utah.
  • Dispute Resolution: Any disputes arising from these Terms and Conditions shall first be resolved through mediation. If mediation is unsuccessful, disputes may be resolved through binding arbitration in Orem, Utah.

11. Amendments

  • Right to Modify: Highland Auctions reserves the right to amend these Terms and Conditions at any time. Users will be notified of changes through Terms and Condition email updates. Continued participation in auctions constitutes acceptance of any amended terms.
